Our HOA is 185 lots large, and was built out and annexed in many phases.

In our last vote sent to homeowners for the purchase of an asset for the HOA, all 185 lots properties were annexed in to the HOA, but 31 were not fully developed and ready for sale. The declarant was identified in there recorded documents prior to the vote.
Should they have been included for this asset?

Are you saying your development is 185 lots, 31 of which are not finished? Who controls the association? Owners or Declarant? Who owns/votes for those 31 empty lots?

Total lots is 185. The owners are in control. The turnover occurred in 2009.

The question is since the 31 lots are still being developed, do they having voting rights?

The 'Declaration' will define membership and voting rights.
