We have a homeowner who has appointed himself as the reporter of violations, however, he is only reporting ONE violation by ONE homeowner. He is on the violations committee, but again, only addresses this one violation. Can I request copies of all of his correspondence with our CAM to show that he is being selective and is opening us up to potential suit? In Florida.

While it's weird, if it's a legitimate violation, why isn't the HOA acting on it?

The HOA seems to be acting selectively in NOT addressing this if it's legitimate. HOAs always have violation "Cops." They can be useful but must be carefully managed.

You are leaving out some details here for us. How many units/homes in your HOA? If it is very small this may be possible. If it is very large than not probable. It also sounds like you are the one with the violation. Is this the case and if so why don't you explain what it is about. This sounds like a personal thing between two owners.

We have a lot of very helpful people who read these threads but I am not sure anyone is able to read minds well enough to know what you are leaving out.

What's going on would provide a violator a defense of "selective enforcement" if there are other similar violations of a similar nature being overlooked. You're probably not suceptible to a lawsuit (in the narrowest sense).
