I'm a owner of a beachside condo in Keywest,Florida that lives in Iowa year round. I use the property as rental income due to property is owned by me and paid for cause it was an inherited condo. I have current tenants in Property stating that HOA mngmnt officials didn't properly oversee pool cleaning employees properly and in effect the Jacuzzi became algae infected and caused bodily harm to him and now he wants to sue me as I'm the current homeowner. Tenant wants me to reimburse him for hospital bills,prescriptions and for pain and suffering. Also for loss wages from work. I pay my HOA dues and All fees required by my HOA. I inquired to my HOA and they referred me to hire an attorney. Am I not correct that the HOA lawyer on retainer should defend me against negligence of pool employees and negligence of management officials and/or All employees/contracted workers.
Can tenant inquire and sue HOA for these damages.
Any help will be greatly appreciated

This is a duplicate post. See the other one to respond. Otherwise, I'd get rid of that tenant as soon as legally able. Plus they are suing the wrong person if they sue. It's a HOA issue not an owner one. You will be involved as you are a member of the HOA. However, do not see how you are responsible if someone has an allergic reaction using a HOA amenity.
