i used to make fun of the city i live in for a *no parking* sign that was installed wrong in our community. come to find out, it was our hoa who requested those signs to be installed. however, even know it was requested by the hoa, wasn't it still the city who actually installed them? i really don't think the hoa can go out and buy their own signs and put them in the ground them selves, can they?

Did you ask the board of directors these questions? If so, what was the response?

Who owns the streets in your community? If you don't know, read your documents. If the association owns the streets and the signs are compatible with the city regulations regarding color, size, etc., it's probably ok.

Our HOA we used the city's signs. We had private roads turned over to the city later. Our HOA didn't allow signs other than "For Sale/Rent". So we could not allow the city to install the no parking signs we needed. We instead got the city's CODE department to allow us to paint our curbs instead red/No parking. That way the police could enforce the no parking law.

Now if we had not gone through the Code department/City Ordinance route, we would have had the City no parking signs installed. Depends on your city and local laws. I don't see anything wrong as long as it's known no parking area.

what happened was-there was a small enough gap between a driveway and a 'no parking' sign, for a small car to fit in. there were 'no parking' signs from one end of the street to the other except for this small gap. after parking there many times, my roommates car was towed. we called the city to see what happened. they said they had nothing to do with it. it was the hoa that towed the car. this was the main street that runs thru our complex so we thought it was a public street. (even a board member said it was a public street, maintained by the city) the hoa refunded the money we spent to get the car back. anyway, i assumed the city installed the 'no parking' signs. but now i'm not sure. i believe our condo had these signs installed. my very long question (sorry) was, can the condo put those signs in by themselves, or does the condo have to get approval from the city and have the city install them? i guess i should ask our board, lol...

As has been posted on your other threads, you need to find out definitively who owns the streets. Depending on your county, this might be available on the property appraiser's web site, or you might have to go in person. You might also search county records for the recorded plat. You've already been given plenty of answers that should tell you what the association and local authorities can do based on who owns the roads, now you need to find that out.

Also check the state rules on parking signs. Anyone can put up the sign only question is are they enforceable. My son's car got towed and he got a ticket in the school parking lot. He was found not guilty and got the towing money back because the sign did not meet the state requirements.

that's a great comment you said, because i'd always been curious if neighborhoods and sub divisions and in your case, a school,they, themselves were actually allowed to go out and buy these signs and put them in the ground themselves? or do neighborhoods have to get approval from the city first to have these signs installed=and does the city or the neighborhood install those signs?

Our situation is we had to get an ordinance with the city to enforce "No parking". Our HOA did not allow signs. That is what the city puts up. So we had to go to the CODE department of the city to be able to paint our curbs RED for no parking. With the curbs painted and the law on the books with the city, we now can call the police to enforce no parking.

It should be noted our HOA was originally County and privately owned. We had our own street naming signs but not stop/yield etc... When we turned over to the city the roads were not wide enough to support parking on BOTH sides. Plus the fire hydrants are on one side. We had an ambulance get stuck due to the parking. The patient did die from a heart attack. Hence why it was so important for us to have no parking enforce. Emergency vehicles could not get in/out in some cases.

I did not realize just anyone can purchase 'no parking' (or any street sign?) signs. If an HOA buys 'no parking' signs, do they install them in the ground also? Or does the HOA buy signs and have the City install them? And does the HOA need approval from the City to install any signs>

If you want to be able to enforce the no parking, then you best have an ordinance in place with the city. You can put signs up all day long, if it's not on the books as "no parking" law/restriction then it has no legal right to enforce.
