When the developer transferred ownership to the HOA they did not name the HOA as the successor. This creates a problem when we need to do something that still can only do ne by the developer.

Need more details. When you say they turned over to the HOA... Do you mean turned over to the owners? Not sure who else they would have turned over to. Plus it may sound like your documents just haven't been updated to show the changes from the developer to the owners. That's something your HOA needs to update and look at.
