Can a husband and wife hold 2 board positions, like treasurer or secretary and vice president?

PeggyH - Depends on what your by-laws state regarding both officership and qualifications of Board members. Please sight your by-laws in order for the question to be properly answered. For example, your by-laws may state something to the effect that only one member of a household can be a Board member, that VP and Pres. can't hold dual officership, etc.

What if the husband and wife own two properties and the husband is both a Board Director and VP, and the wife wants to be secretary?

JoeW1 and Peggy,

We have a similar situation. We are an Illinois HOA and so far I have not found anything in our State's documents prohibiting family members to serve on the Board. Our annual election will take place on 8/30/07 and currently there are two homeowners (father and daughter) seeking election; each owns their own unit.

Our Declarations state that ownership of a dwelling unit shall be the sole qualification for membership; our ByLaws state you must be an owner of record for that unit and only one vote is allowed per unit. Neither mentions anything about "officership" although, imo, I have heard many other homeowners say they are uncomfortable if both these individuals were to be elected on the boardas it could become a "family affair".

I would be curious to learn what you find in your governing documents, Peggy.

No, in most cases they cannot. Most documents read: there shall be no spilt votes, therefore a husband and wife cannot serve on the board. One can be a board member and the other serve on a committee.
