In most HOA's is there a secretary and a treasurer? Our by-laws state you cannot have two offices in the same household and yet the secretary and treasurer's duties have been combined. Would seem if the concern was wrong doing (two offices in one household)you wouldn't want these two offices combined either.

Most HOA's do have a secretary and treasurer. These two officers jobs can be combined if your doc's say it is OK, but it is not a good idea for anyone person to hold two positions.

BB2: In some associations with small Exec. Boards, there are to be 3 members holding 'seats' on the Board in the 'officer' roles of: Pres., V.P. and Sec./Treasurer, a combined role. Your own documents would dictate if Sec. and Treasurer are listed as a dual office or 2 distinctly separate offices. If the Sec./Treasurer is a combined role, then 1 person is to assume it.

Bylaws which state you cannot have two offices in the same household means that 2 residents from the same household cannot hold 2 seats on the same Exec. Board.

If your Bylaws state you cannot, then you cannot.

BB2: Your bylaws most probably state that you cannot have two OFFICERS in the same household. Your written text states two OFFICES in the same household. There is a difference.

Two OFFICERS of the same household cannot serve on the Board. That's your answer.

Our documents combine the Secretary/Treasure positions. However, we do employee a management company that handles the finances. The treasure simply verifies all financial transactions and makes recommendations to the Board. Since no monies are collected or handled by the treasure and the Board authorizes major expenditures, this structure works well for our community
