Is the builder financially responsible for providing the build-out capacity sizing for an amenity?

What do you mean? If the builder/developer still owns the place, then they do what they want.

Yep. Builder owns the place. They do whatever they want. Doesnt matter what you want.

i dont think this is a case of what they want... i believe they are asking about law.. in other words. how i am taking it.. the builder created a building of some sort.. Should the builder have a sign that post how many people can safely be in the building.. maybe like a fire code or something.

sometimes , "the builder can do what he wants" is not always the answer

More detail would help, but if you are asking for example if a builder needs to size an amenity (pool, for example) for the total number of expected homes, I am not aware of any law that would require that. In many jurisdictions developments are approved by local authorities based on a "conditions of approval" document. If the conditions of approval require a 30 person capacity pool, then the developer needs to provide it. Otherwise there is probably nothing that keeps the developer from saying a 10 person capacity pool is adequate for 2000 homes.

What type of capacity are you referring to? occupancy capacity or capacity as X number of homesites? building capacity is set by the fire marshal and Yes here in Clark County, county code sets X number of homesites per acre. right now that number is 6, but developers alway go whining to the county commission crying for a variance and the variance is always granted.
