HOA last meeting has a person ask "since the HOA deed restrictions were not renewed property in 2004 we cant enforce anything.

Someone asked" Well since your, not a real HOA then what about our money" the "president," said if anyone asks for money back they will get it back.

I e-mailed for my money back, this is the response I got.

Also note that somehow they have this "new information about a court case in 2011"....of which nobody said the deed restrictions had a isseu about enforcement til 1 month ago.

is this grounds for a lawsuit? If they knew in 2011 something was not filed right in 2004 and they continue to run things acting if it were all ok?

The comment about refunding dues was made at the meeting in a discussion and no official action was taken one way or the other.

Nobody realized that the restrictions were not valid until a court case in 2011 so it is not as simple as saying deed restrictions ceased in 2004.

We discussed refunding dues and the board was unanimous in that we have no plans to refund any dues.

In addition the dues are not controlled by the deed restrictions but by the bylaws and currently we are operating under the bylaws so the dues would still be collected under them.

You need to provide a lot more info - and perhaps get the name calling and anger under control.

This sounds cluttered, but if you break it down, you will get some reasonable advice.

First, what state?

Wow... That is a cluster. You can't refund money already used for the expenses you all had to spend. Plus it's obvious that one doesn't know what a HOA is...
