I live in a small HOA here in AZ. we only have 20 lots, we have one person that

bought the lot next to him he combined the lots for tax purposes that I under stand

he bought the lot so his view could not be blocked, now he only wants to pay one HOA dues

for both lots? The Budget was set up for 20 lots not 19 so that means that all the other

home owners have to take up the slack for him only paying one fee, now lets take this

even further I have two lots above me I could buy from the owners there are no homes on them

then combine them with my lot for taxes now would I only pan one dues for my 3 lots? now the

HOA budget is lacking a 2 more dues that the budget is even lacking more,

So my question is can this be done to the HOA with out a vote or is it allowed at all

In the eyes of the HOA, it is still two lots and two dues, IF that is how your HOA assess dues per your governing documents.

To echo Richard, you need to read your governing docs to see if they have anything to say about it, but generally assessments are based on the lots as originally platted so the "combined" lot is still two lots as far as the association is concerned. Note too that means two votes in member meetings. Some governing docs have a different dues structure for developed vs. undeveloped lots, again read yours to know for sure.

Richard & Douglas are right, and our CC&Rs make it clear that if two conn units are combined into one, the owner still pays two sets of dues and also has two votes when Owners vote on things.

But check your own docs, Mark. As pointed out, some HOAs' dues are less for unimproved lots vs.lots with homes on them. It's also possible there'd be a square foot variable hereby bigger lots pay more than smaller lots.
