If a notice of preservation was not ever done and the deed restrcitons are not enfocable by the HOA.....

could you still sue people personally?

Or would that also make it to where the deed restrictions dont matter at all.

if i find out that the HOA is fake and that the deed restrictions are not even enforceable to other neighbors here, im going to move a double-wide trailer in the back of my property and rent it out
as that will be my way to get even with the defunct board.

Look at your county's official records. If a MRTA preservation was filed, that's where you'll find it.
