Our HOA (in Florida) has had a treasurer on the the HOA board for more terms than are allowed per the
governing documents of the association. The treasurer had completed two successive terms(2013-2014 and 2015-2016)and not eligible to run again.

When last term ended, the treasurer offered to stay as the part-time treasurer as one other elected board member
was selected, on paper as both secretary/treasurer. The HOA board allowed this for the past year (2017).

The last election (2018#) the same person put their name on the ballot an was elected for a new two year term. And is
serving as treasurer.

In many cases the Bylaws prohibit successive terms (such as no more than two terms) but if one sits out a term, they can run again. I say by your Treasurer be an " advisor" as in not elected for one term, he sat that term it out and could run again.

While an interesting way to approach it, I say your BOD acted properly.

It all depends on the exact wording in your documents but usually there's provision for subordinate officers and if so there's no reason they can't be named "assistant secretary" or "assistant treasurer", etc. They do the actual work while the official executive officer holds the title and retains the ultimated responsibility for seeing that the duties of the office are carried out. I agree with John and don't see any real problem with the arrangement.

Even without an official title, a person other than the treasurer can be appointed to handle the actual bookkeeping, there is no requirement the treasurer does it themselves. In many associations with Management Companies, the treasurer ends up being just a title with no duties.

Did anyone else want the job? Our HOA documents don't limit the time someone can serve in any position. I would just thank the guy for serving in what most situations is a thankless job.
