I put in a request in the past to look at the HOA files as the 720 says you can do.

I did see that they were missing 2 years worth of financial records.

I did not see ANY submissions or approvals for the ACC.

Should that have been part of the files in the few binders they had?

If I put in a request to see the ACC files and they deny me is that grounds for getting the fine money that is
imposed for a HOA not giving you access to those records within 10 days?

Are ACC files among those that owners may inspect in FL, Gary? I don't think they can be inspected by owners in CA.

Also in CA, owners may only inspect financial records for this year and the previous 2 years. What about FL?

I don't have time to look it up right now but if they don't provide access then there's a "rebuttable presumption" that they are withholding the documents willfully. If the records (ACC approvals) don't exist, though, then they don't exist. My HOA is like that. Very bad recordkeeping. Records should be kept for 7 years and include, "All other written records of the association not specifically included in the foregoing which are related to the operation of the association." See FS 720.303(4) for what is ans is not considered an official record of the association. There are a few exceptions that mainly concern homeowner privacy, but almost everything IS considered an official record, including ACC submissions and decisions.
