I am the president of a Master HOA - it is made up of sub-association which are Town Homes and Villas, these sub-associations pay the same assessment into the Master because we share "common area" which is grass and 5 ponds. The single family homes in the Master would like to split and no longer be associated with the Towns and the Villas - the towns and villas hold their own CCRs however they affect any changes in the single family homes because of the percentage needed to vote. Has anyone gone through a splitting process? I have begun the task of getting the Towns and Villas to see how this could benefit them - they would each get a huge chunk of change back but the little stuff like the reserves and what to do with it seem to hold them back. We have plans to discuss with all attorneys and board members but would like to know what I should expect.

Erin, this action could require changes to the deeds to some, if not all, properties which currently comprise the master association. I suggest you consult an attorney who specializes in property deeds to understand the potential costs of the split before you spend too much time, energy, and money on this.

Also, it is likely the master and sub-association documents will have to be modified. I also suggest you consult with an attorney who specializes in HOA matters.

Our village did try this a number of years ago. The master village objected and took us to court. We ended up settling and didn't split but did spell out an court issued agreement that both sides have to live up to. That's another story.
