We have an owner who wants the HOA (Florida) to provide Material Data Safety Sheet information for ALL vendors who use any type of chemical. Is there a legal requirement that the Board comply with this request? Thanks!

This wouldn't apply to your HOA, because it is for employers, but it's a pretty good start.

Does this owner know what she's saying when she speaks of any vendor using any chemical? That would apply to the landscaper watering the garden, or the hand-man repalcing a fence board because wood and air are both chemicals.

Lets be realistic.

They are looking at yard chemicals and insect sprays.

Ask your vendor to provide the Association with the info (only needs to be done once and only for hazardous chemicals) and forward to owner.

Might be. However, since the OP said HOA and not COA, I expect single family homes.

Unless there is a clubhouse or pool, those items would be from contractors hired at by the homeowner.

However if there is a clubhouse or pool, those should be included as well when the work is done.

Is the HOA required to collect this information from vendors in order to satisfy the owner's request? I think the HOA should be able to get it from the vendors, but do they have to?

Does it hurt? Doubtful.

What's it take? A few emails.

Better question, which I haven't seen an answer to (likely because it wasn't asked), would be what harm is done providing the info?

I agree the vendor will have the MSDS sheets usually on hand. And there is no reason the HOA can not ask to get them. Even more so as the HOA is dealing with these vendors. The member may have an issue and need to see them. Thats why company's are required to have them.

best questions is why not ask for them?
