Our community revitalized deed restrictions. There was a home that burned down 9 months ago and nothing has been done to remove the damaged structure. The HOA says the county will not let them take further action, even though they have "offerred" to remove the damaged structure.

The HOA seems more focused on filing a slander and libel suit against a non homeowner. It would appear the Board was offended by some of the contents made by a caretaker living in the area.

Ugh.

Sorry for your issues.

Regarding the home fire, keep in mind that legal issues may delay repairs for awhile.

As an example:
There was a home in our development that had some electrical work done.
A fire started and it was two or three months before repairs could be done because insurance and fire investigators were trying to determine the cause of the fire and if there was any negligence.

That is unfortunate Michael. An HOA under development adjacent to the one I live in lost 5 homes under construction to squatters 18 months ago. It took over 8 months alone before the developer could remove the damaged structures. Those things unfortunately take ALLOT of time. As for the slander issue, are you a board member? Honestly I would let it go, it is not worth litigating. On a side note, as a home owner in an HOA... GET LOSS ASSESSMENT coverage on your homeowners policy, ASAP!!!!!
