Can a Board member add a new item to the agenda during a Board meeting? Was curious if RR's addresses this or not? Any feedback would be greatly appreciated!

Unless Indiana law prohibits it or your governing documents requires the use of Robert's Rule of Order, then it would presume it would be legal.

Sheila might know about IN law. If it doesn't prohibit adding AT the meeting and your own documents don't, any director can add. Just one citation from Robert's, RONR, 11th ed., p. 16, states the board adopts an agenda with its vote at the beginning of the meeting.

In CA and some other states, no time can be added to the agenda during the meeting. In CA, for instance, the agenda must be posted 4 days in advance of the meeting, and basically, only something urgent can be added at the meeting.

I don't believe Indiana law addresses this. Our governing documents are silent on how we conduct the meetings. Now, the Board did pass a SOP last December. In it, we agreed to use RR for all Board meetings.

To keep the agenda from being bogged down and that you can finish before midnight, you can stick to whatever you wrote in your SOP. If it isn't addressing how the agenda is set or who does it, that could be added. For example, you might set a deadline in which board members may submit suggestions - if it hasn't been submitted, it won't be addressed. Whoever sets the agenda (perhaps the board president and secretary), should review the suggestions to see if the issue is best handled by the property manager - then the property manager can issue a brief report at the meeting or tell the board the issue is pending (followup will be required at the next meeting).

We have a small HOA but it's not uncommon for a our board to ask if anyone wants to make a motion to discuss new business i.e. something not in the agenda. If the motion is seconded the item will be discussed and added to the meeting minutes. It should be noted however the board is under no obligation to do this.
