Who or how do I get a copy of the restrictions or covenants for my subdivision. I don’t know who the board members are. It’s lexington heights in Lexington south carolina

Covenants should be filed with your deed in the county records. In some counties (the one I live in, for example) you can search and download for free online from the County Comptroller's office. In smaller counties you often have to go in person to the courthouse, recorder of deeds, or whatever office stores those records in your locale.

Corporate bylaws, articles of incorporation, and rules and regulations created by the board are not required to be recorded in most jurisdictions and would need to be acquired from the association if there is one and it is active.

They are almost always part of your closing documents with your mortgage company.

They are not always part of your closing documents. Not every state makes it so that the seller has to turn the documents over at closing. They are considered public documents. So the CC&R's are at the County Courthouse. The Articles of Incorporation are STATE level. Most likely on a state website. The By-laws are an internal HOA document. The HOA would have those if they exist.

As for knowing who your board members are, that's not going to be in those documents. Probably have to ask around to see who fesses up...

Ah ok MelissaP1. It was always standard operating procedure for us to include those in closing here in Texas. Also, every friend I've ever had in Texas gets theirs from the hoa at closing too. Guess it's not a national thing. Also according to our open records act a management company must file their status with the HOA with the county too. So, you could find that out then using the open records act you could request the names of all the current board members. In most cases those board members will also be homeowners so you could then go to the county appraisal district and do a search and even get their addresses. :-) But that's in Texas.

Obtain them from the Register of Deeds at your county 'courthouse'.

The easiest way is to require a copy before closing.
