Last August, Hurricane Maria came through our community. Fortunately I was not not affected. However, my neighbor unfortunately was. 11 months have elapsed and he still has not repaired his roof. His reasoning? A $5,000. deductible. But that's his problem not mind. For several months now all three tarps have faded, turned to pieces and shedded. This debris has ended up all over my side and back yard. I have reported this issue to my HOA and nothing has been done about. They state that he has a right to protect his home. True, if the tarps were in good condition, which is not the case here. My concerns have fallen on death ears. Just today I collected shedded tarps pieces and strings of blue tarp and showed it to my neighbor letting him know that for months I have been collecting shedded pieces of tarps falling from his roof. He got all bent out of shape. That's what I was trying to avoid.
So where do I go from here? I have finally had enough with this neighbor and have put my house up for sale.

If you are selling your house, why would you spend any effort - other than cleaning up the debris - at this point?

Before it can be an HOA issue, it would need to be covered by some form of the CCRs - is it?

If it is covered by the CCRs, then the Board should be involved related to that covenants issue.

If it is not covered by the CCRs, then you may be out of luck.

We could go further into this, but if you are selling you house ....?

Maria didn't become a hurricane until mid-September and it didn't affect Florida at all. Leaving that aside, what do your association's governing documents say about a homeowner's responsibility to make repairs? Maybe your local building codes or ordinances have something to say about how long tarps may be left up.

Do your CCR’s not give a time limit to address issues??? For example when a subdivision is set up the CCR’s will note that home construction must be completed within X amount of time, then landscaping must be completed within X amount of time after construction completed. Do your CCR’s note a completion time for construction ... OR ... you might check with your local Planning Department as the Local Government might also have such time constraints to avoid potential “blight”.
