Last year I bought a house that is part of an HOA. There are two units - A&B. I own unit B and unit A is for sell. I find it odd that each owner has 50% voting rights so if we ever disagree how do we come to a resolution? Since unit A is for sell I want to amend the HOA to gain majority voting, aka 51%, aka President, etc. Does this sound right or is a 2 member HOA a normal thing?

-- If the two members of the two-member HOA disagree, then that means the status quo continues.

-- You could try to buy the agreement of the other member on any issue important enough to you.

-- To amend the covenants so that you had 51% of the vote likely requires the consent of both owners. Read your HOA's covenants for the exact requirements to amend.

-- Is there a road or some similar common land that the two homes must share and maintain jointly?

-- This is the first I have heard of a two-member HOA. Are there bylaws that go with this hoa? How about articles of incorporation? Are you sure there's a HOA and not simply a set of covenants that applies to both pieces of land?

What is the exact verbiage of your Bylaws and CCR documents with regards to voting??? Usually the documents will note that each “Property Owner” has one vote. I would be surprised to see any unit noted as 50% and have not seen that in any other documents I have read to date. You may also want to check your State Statutes as they can potentially override your CCR’s on this issue.

Potentially it will be a cold day down below before you could amend your CCR’s to allow you extra voting power. Even though the neighbor home is for sale, it is still owned by someone who has as much right to a vote as yourself.

Well considering you have to have the other vote in order to amend your documents... How well do you think that will go over? "Please neighbor let's vote to give me 1 % more voting rights"....
