Had our regular Board meeting tonight,. Board member at large, started snickering and laughing out loud at one of the Homeowners while she was speaking.

Remainder of Board stepped in,. however Board member at large seems to think he was in the wrong.

This is the same Board Member at large that has stated "the Homeowners voted the Directors in to make the decisions and that's it".

He also seems to think the Board can authorize and spend whatever funds they want on any improvments as, capital expenses, etc as long as there isn't any Special Assessment necessary.

So what's your question? If you're asking what should happen next, I would suggest the board might want to have an executive session and remind everyone of what's appropriate behavior, telling this guy he was out of line and to behave himself next time. If he doesn't, he should be reprimanded.

If you're looking for a way to boot the man off the board, read your documents, as there may be instructions regarding a recall. Note the board itself can kick him off, that will have to be up to the homeowners, who will have to vote him off. If you want to get this started, talk to your neighbors and see how many are also concerned about his behavior. Maybe all of you can write him a letter (all of you signing it) and copying the board - sometimes, that's enough to calm him down.

If you want him off, consider whether the man has done anything else that's concerning (perhaps he was having an off night, but has otherwise been ok). If there have been other incidents, when did they occur and did anyone call him out on it?

Are you on the board? If so, what type of relationship do you have with him - maybe you might want to speak to him in confidence about his behavior and what the Board can or can't do. If he has a problem with transparency, maybe this isn't the job for him. While it's true the board is authorized to make decisions to run the association (that's why they're there), this doesn't happen in a vacuum. Homeowners have every right to know why decisions have been made and how it will impact them. They also have a right to vote out board members or recall them if they're dissatisfied with their performance - be sure to remind this man of that factoid.

The most obvious action by the rest of the board is to instruct him to refrain from his interruptions & rudeness, or he'll be asked to leave the meeting.

Meantime, his opinion about expenditures doesn't matter much as y'all outvote him, right?

(Escaped treasurer??? I thought I was the only one! Served on my board for 10 years, 5 as treasurer...boy, I'm glad that's over with!)
