our President of the HOA is not communicating with the other board members. He and the property manager/handyman are basically running the HOA. No board member initiatives are accepted and the infrequent board meetings are basically the president telling us what he and the property manager have done or are doing.. The property manager sits in on all of the board meetings make it difficult to discuss issues that concern him and he interjects and tries to shape the board meetings. The president is also functioning as the treasurer. The president does not return phone calls or e-mails. I am concerned that their rogue behavior could put the entire board at risk of lawsuit if they make a mistake. We are in South Carolina. Are there any remedies for this other than just try to vote him out the next election? Thanks.

Your governing docs could potentially be different, but in almost all cases the members elect directors, the directors elect the officers.

If the rest of the board doesn't want this person to be president any more, then call a board meeting with proper notice and elect a new president.

Concur with Douglas.

For what it is worth, and sadly, I think what is happening where you are is pretty common at HOAs. But it can be stopped.

The only other option is to gather support and do a recall.
It's likely easier to gather support and not reelect.

A different option would be for someone to step up and volunteer to serve as President or Treasurer. The offer might be rejected, but at least the effort was made. It's possible the calls are not being returned because there just isn't enough hours in the day.

I agree with the others but would add that it does not sound like this president understands his role. Yes, I'm stating the obvious, but has anyone talked to him and advised him that he has no authority to make decisions on his own, that decisions are made by the board and he has no more authority than other directors? If not, maybe he just needs to be educated.

Of course, this means someone else has to be willing to take on that job.
