How to file a Lien in New Jersey for a Condo Association to a unit that is not paying dues? What form would I needs and what is the type of liens that is needed? The unit is already 6 months behind.

It's best to consult an attorney or legal service. Each state varies on how a HOA files a lien. Some states require the HOA to have an attorney file the lien. Other states a lien is handled differently. You can call the courthouse and ask the department that issues liens on the process as well. I am sure they are none to happy to explain it to you. Just be aware they may just tell you to get a lawyer and not want to deal with you personally.

Most likely they won't explain anything at all. They'll tell you that they are not authorized to provide legal advice and to contact a legal professional if you need help.

I was kind of being sarcastic with the "none to happy to explain"... Hence why I said don't be surprised if they tell you talk to a lawyer....

My advise, similar to others, is to hire an attorney for the first one and insist on copies of the filed paperwork.

However, to offer an answer to your question, I offer the following:

New Jersey HOA and COA Foreclosures from nolo

Priority Lien - New Jersey from CAI

Remove HOA lien NJ from an ask the attorney website

You may also want to ask the county clerk. Here is something from the COUNTY of CAPE MAY:

States vary. In SC any BOD Member may go to Magistrates Court (Small Claims Court) and for a fee of $35?? file a collection action on any owner behind in dues. If the owner does not show alien can be issued.

In other words in SC we do not need a lawyer to file a lien.
