The water is coming down the hill from the property above,does the HOA or the property owner have to fix the ditch so the water will flow to the drain,we are planning to get an engineer to evaluate the problem,thanks Gary ,located in Aledo,Texas a

Have you asked your local government authorities? Potentially when the subdivision was built there should have been surveys and other items regarding drainage and protecting properties. They might even have their own engineer take a look at the problem.

You may need to contact the Corps of Engineers. Sounds a bit extreme but some areas are under their control. Especially involving things like natural waterways or flooding. We had to contact them for engineering consulting on a stream that ran along our boarder. It was taking a homeowner's fence out. They had to give approval for any modifications to the city/county to make changes.

I would contact whomever maintains the roads.
I would also contact the local storm water management of the County. They can advise as to who needs to address the problem of the water flow itself.
