I am trying to get a quote for our HOA which is a development of 55 homes on 1 acre tracts. We apparently own 2 common areas that have no buildings but one common area has a small waterfall with a tiny pond. In review of our current policy, we have not insured the commons but have insured a small building on the former president's property. The currently insurance company insists that we need to insure someone's property. The underwriter from another insurance agency that I received a quote from has not removed the building from the quote despite my request to do so. I am wondering if part of our problem is that we are using a USPS P.O. Box for our mailing address and have not obtained a street address for the corporation. Does anyone have any recommendations or thoughts about this? Thanks!

None of this has anything to do with D&O insurance. An example of the reason the insurance company refuses to insure only the property and not exclude the shed:

Say a preschool class was sitting in the shade of the shed drinking cool-aid, and the shed fell and flattened them. Wether you like it or not, the property insurance is going to get dragged to court wether the shed is their responsibility or not.

We use a PO box as well.
That is not an issue.
The Association might need to be incorporated (minor paperwork) for policies to be issued.

There are very few insurance companies writing polices for HOAs.

Personally, from what you mention, I would only worry about having the following polices:

Liability (1 million coverage minimum)
D&O (Directors and Officers)
Crime (which covers embezzlement situations)

Talk to the larger carriers.

Actually we are incorporated as a non-profit. Both insurance companies that we have talked to require us to have a physical address. Since the HOA owns a small area at the entrance to our development (where the waterfall/pond feature is located) then my thought was to get a postal address for this common area.

I understand that the D&O insurance does not include the community property but the current policy insures a homeowner's "shed" that is not owned by the association. I am trying to get it removed and get coverage for the 2 community property areas owned by the association.

Insure the property, including the sheds. Bill the owner of the sheds for the difference and send him a demand letter to remove the structure. If he doesn't comply, demo it and then adjust your insurance.

I think Paula is trying to get the insurance company to remove the shed from the coverage, not trying to get the shed physically removed.

Yes, I want the structure removed from the policy. It was owned by our former HOA President (who recently passed away). I think it was placed on the policy when our Association was turned over to the community and the non-profit was being formed. The insurance policy was never updated to include our two community properties.

And like I said, the insurance will not because they would never be able to duck some responsibility in court. Hence, they want money.

Our physical address is the street names, city state zip.

However, all mail, etc. is sent to the PO box.
