I am in a building who has a president and a treasurer. Ive been a unit owner almost 4 years. For as long as I have been here there haven't been any association meetings. The president yelled.at me tje last time I asked about them. The treasurer is her friend. The treasure slips a typed out sheet under our doors neaxh month. The sheet shows expenses ans balance of reserve. The balance is almost the same each month. They type on the bottom of these sheets nthat "bank statements are available upon request". But if unit owner request the statements, the requests are ignored. Some of the unit owners are fed up with this arrangement. We dont know how to go about the problem with this president and treasurer. Also the president nhas friends in some units that will never go aginst her.Does anyone know whatnwe can do? We can't afford an attorney.

Your CC&R's undoubtedly will explain how a special meeting can be held, and what can be done at this special meeting. Get a group of like minded individuals together and pitch those two out of office.

Contact your title company. CC&R's are attached to title, and you should be able to retrieve them thru the title company or thru the county for a fee either way.

it's your bylaws, Pam, which should say how often the Board should hold meetings. It doesn't matter how old they are. I also think IL law has statutes that protest Owners from abusive Boards. It looks like you need help from someone who understands how HOAs work.

PamB9, usually the Declaration and Bylaws for condominiums are on file with one's County CLerk. I recommend you look up the phone number of your County Clerk and ask how to view the condominium's Declaration and Bylaws. Pay for a copy. Then look in the Bylaws for the rules on how often elections must be run; how to remove a director. Report back.

Meanwhile, read the records viewing section of the Illinois Condominium Property Act, linked below. If you wanted, you could write a letter to the President and Treasurer asking to view and copy the Declaration, Bylaws, and financial records you want, "pursuant to Section 18.5(d) of the Illinois Condominium Property Act."

Good advice from Augie, Pam.

Also, if you have a property manager who works for your HOA, s/he will have a copy of your bylaws and CC&Rs. The bylaws also will tell you how often there must be meetings of the board. Usually theres a minimum of quarterly.

How many units are in your condo?

Pam, are there any other owners who are willing to take over the positions? If you plan to boot these two out you will need replacements. Apathy is a terrible thing.

The condos dont habe a property management. Its just the president and treasurer. There are 12 units. Some of the other owners are her friends.

There is a unit owner that is willing to be president. I said I would help. Is there anyway we can force them to show the bank statements without getting an attorney?

Mark is right. Vote them out. However, make sure you have the majority of other homeowners when you try. If you think that the President and Treasurer are friends with most of the most owners, it will be harder. You just need a better argument than the president. I can almost guarantee the president and treasurer will fight your efforts by getting proxies of their "friends/other homeowners".

CC&Rs are the Covenants, Conditions, and Restrictions placed on your property. They would normally include any assessments you have to pay and state what requirements and restrictions come with owning the property. Bylaws are a different document that usually dictate how the association is operated. For example, the bylaws normally state how elections are conducted and when meetings are held.

CC&Rs and bylaws sometimes share the same information but they are not the same thing. Bylaws cannot put restrictions on your property that do not exist in the CC&Rs and, if there is a conflict, the CC&Rs control.

Now they want the treasurer to ne president. They put up a sign dor a meeting in March for a vote. So then we would need a new treasurer. This president and treasurer have morw friends in this building. So it is hard to get them out. Is there an organization that anyone knows about that we can report this to?

Yes... The OTHER HOA members... That is the "organization" you report it to. So what if the President/Treasurer are "friends"? I'd don't know why I'd want to work with someone I hated. You are all neighbors after all. Act neighborly is what being in a HOA is all about.

Again, vote them out. If you can't get the vote, then maybe it's just you with the issue?

Melissa, the president and treasurer somt hold regular meetings. Unit owner dont see receipts, bills etc. I have been here over 3 years. It seems like other unit owners dont question as I come to rhe conclusion they must ne friends. Thats qhy its hard to vote them out. Tjere are otjer things the president does that will take.to long to type here. You probably didn't run your hoa like this. I dont think Im the one with the issue

So how does their friendship keep them in office? It seems it would be the friendship amongst ALL of the other members that keep them in office. So what is your big worry about the budget? Have they asked for special assessments or raised dues outrageously? It is a non-profit so they should be collecting as much as they spend. So if your HOA isn't asking for more money, then it's probably running okay.
