Hello All,

I just saw this on the front page of HOA talk, this is apparently a real estate Q&A column.

Reading this, it seems to me the person answering doesn't understand the difference between bylaws and covenents, does anyone else read it that way? This is bad news if so called experts with a broad audience can't get simple stuff right.

I think it's just the standard confusion that seems to exist when people talk about "the bylaws". No matter how many times you try to explain the difference in the governing documents to people it seems to go in one ear and out the other. We just received a newsletter from our new president today. In it she lays out how our Articles of Incorporation were filed with the state years ago and, "this document is the basis for our By-laws, [CC&Rs], and association Rules. These must be consistent with the Articles of Incorporation."

Which is nonsense, of course, but some people will never "get it".

It may also be the copyeditor was asleep at the switch or the writer did know the difference, but didn't read it completely before sending it off for final editing and publishing. Some automatically assume everyone knows or will just Goggle it if they have questions, but a lot of people don't go that far.

That said, I think you have a great point - a lot of people don't have a clue about HOAs, why and how they came to by and how they operate. Part of understanding it is learning the lingo and if you don't take the time to figure out exactly what they mean, you may have a hard time understanding everything else.
