At our last HOA meeting there was a video camera in the room pointing at all the property owners. One of the members requested in writing a copy of the video. The board member replied that it was his own personal video and he did not have to provide any of the members with a copy. I know in Arizona a member has the right to record the meeting without permission, but what about when a board member does it and won't provide a copy? How can he sit on the board and say it was his own personal video?

Well they don't have to provide a free copy if that is their recording equipment. It shouldn't really matter because the video most likely would not be permissible in court. It's not an official record of the HOA. So if their end game is to use it as "evidence" for court purposes, they are going to have a uphill battle. Many states it has to be announced one is being recorded and agree to it. Plus the video is not HOA property so they could not use it for themselves either. It's basically has to be personal use only. Any other use of it may be a violation of law and not just the HOA's.

The board member is still a member and has the right to record. His recording did not prevent others from recording. It should have been announced at the beginning of the meeting that THE Board was not recording.

That he pointed at the owners rather than the board may be interesting. Is there a loud mouth or trouble making member at meetings? Are they trying to prevent people from participating since some don't like to talk on camera? Is there a long winded member that they would like to show it to so that he may pick up the pace in the future? I was going to start recording our meetings but the problem disappeared so I never bothered. We recorded where I lived years ago and it does seem to make people behave better.

This is where the gray area comes into play.

Was the recording made by the individual as a member of the Board or simply as a member of the Association.

They are telling you that they were recording it as a member of the Association and not as a board member. You believe otherwise.

You are likely not going to obtain a copy unless you go to court. Then it will probably be a 50/50 chance.
