Hello all,
I recently spoke to some new renters in our HOA. They just so happen not to have a car. I know the unit they are renting has 2 assigned spaces that go with the title deed. One of the other nights I saw them parking a borrowed car on the street not in our secured parking garage.. They told me that when they rented the unit the land lord told them it did NOT include the parking spaces int he garage. ( odd as they have been sitting there empty since they moved in). I advised them the spots belong tothe unit. Nobody is using them and they should be able to park where their unit's assigned spaces are. Or if they wished consider renting them as parking is a premium here and this just sounds looney. The landlord has been told she can't use the ammenities when they have someoen occupying thier unit ( for example they came adn used the pool when they had tenants.. they were not guests, just showed up )
Can a landlord not allow thier tenants to have parking access that is rightfully titled to the unit?

Depends on what the lease says.

I'm not sure why you are involved.
This isn't your unit.
You are not the renter.
You are not the landlord.

In NY you can, and I did.

I paid separate for my underground garage parking spot, and when we rented out the apartment, I did not include it.
We kept it empty until we purchased a new vehicle, then put it in the garage as we only used the car on weekends.

There's nothing wrong or illegal about it.

But I'm also wondering why you're so interested in this?

An owner can rent a unit and retain use of the parking space himself. That would include keeping it vacant if he chooses.

As said earlier: why do you care?

If they do not have a car ... what is your actual question? Also, this is potentially an issue between the landlord and the tenant ... not the HOA.
