This is a very serious situation. One owner who is very well known for her meanness and trouble making is at it again. We just do not know how to handle the explosive situation. For years now, this owner on the lower level of a condo unit is at ware with the tenant in the condo unit above her. ALL sorts of accusations of his slamming the door... walking heavily on the floor above her. ... and lately his eyeing and camera shots of a young girl across from him. The owner below has called the owner of the unit above and asked them to get him out. I know the tenant above and seems like a likeable guy. The owner below is notorious for getting after someone by using other people so she is always in the background. This actually started 2 years ago when she tried to get him out... I remember vaguely that the police were there and told the owner below that if she is reported as being at his door again, she would be jailed...As the HOA, I want to NOT get the HOA involved but this owner is DRAGGING the HOA into the web... any suggestions?

Unless and/or until there is a violation of the Covenants and Restrictions it is NOT an HOA issue.

The HOA is not the 'nanny' of the members.

Let law enforcement handle the matter between two (or more) members.

If, however, there is a nuisance clause/restriction in the 'documents' then the HOA would need their attorney to draft a 'cease and desist' letter to the offender.

IMO: the HOA should MYOB which is the maintenance of the common elements.

My first reaction is the association should stay out of it unless there are covenant or rules violations that need to be addressed.

What, Alex, do you mean she's "dragging the HOA into it?" In what way? You board members do not have to give in to her (whatever it is)

I am with the others ... unless the Owner can state CCR violations which the HOA must address ... let the police handle or the owners between themselves.
