Is there anything wrong with days that are all for the children and days that are adults only. Equal time but separate days.

I live in a mostly retirement community. Average age is 70-75. Hot Springs village. I see in the law it states equal time.. But you can look at it in two different ways. One meaning equal time as all are using the pool at the same time.. We adults would prefer to swim in peace without splashing, crying, running around kids.

We can't tell the children to stop disturbing the older adults and the parents can't seem to keep their kids under control these days or they think their little darlings can't do not wrong. I personal don't think this is fair to be forced to be with the children every minute of everyday the pool is open. I don't think making the children get out of the pool every hour or two helps anyone. We would still hear their noise and running around. I would like my peace just as much as they want to scream, do cannonballs cry and-run around.

It runs afoul of the Fair Housing Act.

You could skirt this by not referencing age, but designating times for "lap swimming only" or "quiet time, No splashing, diving etc." and/or programming certain areas of the pool for water exercise or water walking classes. Then the only people who could be in those areas would have to abide by class rules which could limit behaviors deemed disruptive to class.

Are you in a deed restricted community exclusively for people 55 and older? If Yes then yes there can be open swim times for children.

If you are not in a senior community then I suggest you use the CC&R's and code of conduct pool rules to put the parents and children in check.

Our pool has high rise residences on two side of it. Our rules about loud behaviors, roughhousing are strictly enforced. No running or diving is permitted.

Seems like your Board, Dory, needs to tighten your existing rules and enforce them. Can loud behavior be fined? Can parents who let their kids make life miserable for there be kept out of the pool area as a penalty? Our CC&Rs permit us to do just that.

Most likely you may not restrict hours that kids can use the pool, but you nee to check your state and other codes.

LetA hit the nail ... if you are deed restricted for 55 and older. If you are not you must follow Federal and State Laws.
