One owner has a husband and does not work anyplace that I know of. That owner is extremely upset that the HOA will not hire her husband for handyman jobs at the complex.

And if they don't move on, best to ignore them. If this guy wants to work as a handyman, let him present his credentials and make a bid for the work like any other contractor, and then the board can decide. If you already have a handyman you're happy with, that's the end of that.

I have no issues with hiring someone from within the membership or residents to perform work.
However, we do require that they are treated like any other company we deal with.
This means the following:

Bidding on the work
Showing proof of license (if required)
Showing proof of insurance

If the individual has those items and has the low bid, we use them.

If they have all the items in place as Tim noted ... potentially not an issue. Unless in the future they do no perform well and the HOA needs to FIRE them. At that time you potentially could have many upset neighbors who might choose to go on the war path to recall the Board because you fired their "friend" neighbor ... or just have a bunch of neighbors angry at the current Board when you cannot by law give certain details on why you fired the neighbor. I am against hiring anyone in an HOA because it can in future potentially divide an HOA ... sorry I do not like in any way any opportunity of dividing neighbors.

I won't hire a resident. Over the years we have had many people volunteer their skills from legal work to landscaping. I can't justify paying a resident for things other residents have done for free.

You have to be licensed and insured to work for us. Unless the job is something pretty small and less than $100 we may let a local person do it. Something like cleaning the pool area. Otherwise, people think the HOA is an income source. Which last I checked, it wasn't. Even the board members work for free.

BTW: NEVER EVER give a "Not pay dues" option to any member in exchange for work. Your taking away the HOA's income if you do. Plus when they get mad and stop paying their dues all together. What point do you start with lien process?

Plus, you then have to file paperwork with the IRS on forgiveness of debt.

It's better to collect assessments normally.
Have the individual submit an invoice and write them a check.
