Please let me know if our BOD is acting in the best interest of our homeowners.
Our Declarations state that the use of enjoyment of the Community Area shall at all times be subject to reasonable rules and regulations duly adopted by the Association.
I have been told it is up to the BOD to interpret our governing documents. Actually, I don't believe there is one reasonable person on this Board let alone the ability of interpretation.
Now, it was announced at our February 8th meeting that this handbook has been revised and it will be mailed to all homeowners for their review as the BOD will adopt these Rules and Regulations at their next meeting which is scheduled for April 12 BUT they don't want to point out specificially what changes/revisions have been made[note: handbook is well over 30 pages comprising of 30 sections]. Today is 3/09 and have not received it---guess they are waiting for the last bloody day!
Anyway, at the February meeting I asked why they hadn't taken the initiative to post our current handbook out there. Their response was there is no reason too because it has been updated and will be mailed. Also, they do not plan to communicate specifically what changes/revisions are being made. I know for a fact there are several homeowners who didn't even know this handbook existed so they have no basis of comparison. I know of one particular change made because it was mentioned in our March newsletter and it is currently not in our handbook. So, in essence, until it is adopted it cannot be enforced.
And when it comes to due process, more often than not, I have even heard homeowners just paying the fines and not even questioning the legitimacy of the violation. Unbelievable but true!
Anyone else have these problems too??? ReneeD

I recently became a board member of my community because I was also receiving poor responses and no communication from the previous board. Now that I am on the board I am learning that it is a time consuming job and the number one focus always has to be for the best interest of the homeowners. Since your board is not interested in thinking of homeowners first, I suggest applying for the board.

I have found it to be a very rewarding job because every single homeowner loves friendly, responsive people. Our board meetings have actually changed from a bitch session, but to a discussion/idea session.

Obviously time is an issue, but sometimes you just need to bite the bullet if the thing you are fighting for means enough to you. Another option is to join a committee under the board, at least you can get involved and have direct communication.

I agree with Amy but it also depends on the president. I was on the board because I experienced the same while off the board. I learned even worse things while on the board. I gave up the position after a long period of time and now I'm working with the concerned homeowners instead. With a small group of five, we have made a bigger difference than being on the board. We studied our documents together and because of that we were able to inform the board that they need to vote in a nominating committee at the annual meeting. Because we could back it up with our docs, this time it happened and I am one of those on that committee. Now I have the right to campus our homeowners and encourage new board members. We need a new board bad. It's the same ones servering for years and this is our way to change it. They too take everything in their own hands, make changes, have special meetings so homeowners will not attend, etc. My goal is a BOD of directors we can trust and have involvement with and in turn create a community..... Hard work but we'll do it.
