We have a religious org who wants to hold an informational session in the clubhouse but not rent it out. I don't see a problem with it but are there rules preventing religious orgs from using HOA amenities? Will this open up another can of worms? Some folks want them to rent it out and others are saying they can use free of charge. Note: Our clubhouse is open to all residents, clubs if its not booked on a given day. I just wanted to read everyone's take on this.

If you open your clubhouse to the public, whether you charge rent or not, you will likely have to be in compliance with the Americans with Disabilities Act. The ADA does not apply, generally, where a facility is not open to "the public".

If you have an owner that's a member of the religious group then potentially that owner might be able to reserve the clubhouse for a meeting of the group. But if it's really an outside group without anyone "on the inside", I would be hesitant. Besides the ADA there may be insurance considerations and additional tax liability. The documents in my HOA specifically state that the common property is for the use and enjoyment of the homeowners. Some will try to stretch the definition of "friends, guests and visitors", so you should have a clear policy on these things.

If you are a resident and the clubhouse is open to all residents when not booked, and assuming you don't try to close the clubhouse to other people, I don't see the issue. If you're bringing in people from outside of the community, I would check with the HOA to verify who can come in as "guests" and how many such guests you can have.

Only residents may reserve our Lounge and they must pay $10-25 depending on their group size, and leave a refundable cleaning/damage deposit.

If your policy is that users pay rent, why would anyone want to offer a $ break to a religious org?

Assess all groups equally so you don't get accused of preferential treatment to any one group based on who they are.

My initial blush is do not rent nor loan the clubhouse to any outside organization. That said, charging outsiders more to use it seems fair. Also charge all outsiders the same
