Hi There,
My HOA took the carport rebuild project and changed my carport spot without any notification to me. My old carport had concrete slab foundation but the new spot don't have any slab rather it's just tarmac uneven surface. Can HOA change that without my concent and I am the only one they changed in the whole community. I opposed the rebuild of the carport, is that the reason they are doing to me. What are my options.

Please note that my grant deed says this:
"An exclusive easement to use the parking space, as shown in the plan"

Unless you are specifically assigned spot "X" and says so in your title and deed

So, Parwan, your deed shows you have an easement to use space XX. How is that space identified in the deed? By a number? Or?

Do you know if you own this space or if you just have use of it?

Either way, the HOA should not be able to take it away from you if it's identified in the deed.

What do your CC&Rs say about the carports and their space? That might help us better understand your situation.

Good questions.
