we are listed as a condo, we have been non conforming for over 30 years. We are 2 buildings with 2 units per building total of 4. We have had survey and have been approved for separation with the county to become. Town homes. Problem we have not been able to agree on deed restrictions. What are the penalties from the state for being non conforming and defunct there are numerous fines for not abiding by condo docs. My concern is no insurance.so we either separate or I will be forced to call state to face consequences.

I don't understand. Do you mean non-conforming to local zoning? That has nothing to do with the state.

Think I follow a bit. When we go to tax assessor's office for our homestead tax filing there is a list of types. They are like single home, condo, or trailer etc.. I lived in a "townhome" but it was not on the list. So it was hard to identify with the state my home type as Townhome is not an option. I was in a HOA that the homes were individual but a few shared a wall. The owners owned the house and the lot the house sat on. Everything else was HOA property.

Did not face any penalties for identifying my house wrong. Think I ended up going with Single home versus condo. Just because fit that description more. Not sure if that is what your talking about or not. Still not clear. This is the closest could think of. If so, then ask the tax assessor's office. I don't think there's an issue.
