Hi,

I am on the board of a 40 unit town home owners association. 10 blocks with 4 units each.
Currently, every unit pays the same HOA fees. We are about to raise the fees and I am wondering if we should start charging end units more than middle units.

I am looking for some guidance on this topic.

You must comply with the assessment structure within your governing documents (typically the CC&Rs).

If there is language that costs are shared or costs are equally shared, then you may not change the assessment structure.

If there is language that specifies members pay based on square footage, you would already be doing that.

I suspect that once you do your research and read the governing documents you will discover that what you are proposing will not be allowed without amending the CC&Rs (which must be done first).

My complex has a similar layout to what you describe, but we all pay the same dues, since it's what was established in the CC&Rs. Like Tim said, whether or not you can do that depends on the documents. I know of places that charge varying dues based on the size of the unit, so it's definitely something that is done, but it either has to be set up that way from the beginning or you'd have to change the appropriate document.
