I have a dispute on a condo I recently purchased. THE HOA claims that my parking spot encroaches on common area. We did a survey and it indicates the building was not built according to the property map and that they did not account for the common area next to my parking space. Now the HOA is claiming that my spot is smaller than mapped and that I cannot park there.

Any suggestions?

Contact your title insurance company.

1. Too bad the survey was not done before purchase.

2. Title company first.

3. There may be language in the documents that is useful to you. For example: suppose your neighbor's house is over the line, does that mean he no longer gets to use part of his kitchen?

Thats what you paid title insurance for, call your title company.. Hope it works out for your favor, sounds like someone just wants to stir the pot.

OK, I'm dumb. Exactly what DOES title insurance provide coverage for? The surveyed parcel? The land? The chain of title? The accuracy of the property description on the deed?

You may contact the insurance company because you are paying them.And its purely a bad luck.
