We have a Licensed CAM that we recently noticed checking bids presented for Lawn Services and Janitor company don't exist we checked with Sunbiz, the County and nothing.

All we can think is that he is taking it like a side business but is this legal.?

If I am understanding you correctly, you are saying that the CAM is paying companies you have not heard of and think that those companies are owned by (or associated with) the CAM.

Keep in mind that companies do not have to be incorporated.

Companies may or may not have to be licensed.

Have you asked the CAM who these companies are and what services they have provided?

The post isn't very clear, but I thought it could be that the CAM is presenting bogus competitive bids, possibly to use a company they prefer.

Well if the invoice has an LLC. Should be registered? I called Sunbiz, and other agency and they said it was illegal because it meant he is working under the table not paying taxes?

My suspicions is that he makes this companies up, and for example the people that do the cleaning or janitor charges $80 per hour.? I think he pockets part of that and pays who ever what ever? That would be fine if his a staffing company I hope.?

And what has happened is that we use to get a janitor once a week, but since he is managing went down to twice a week? because prior to hiring him we use to pay $40 an hour.? So our building is really dirty with spider webs and things like that.?

As Tim said - HAVE YOU ASKED THE PROPERTY MANAGER THESE QUESTIONS? If so, what was the response? If you don't get a response or get evasive answers to additional questions, don't consider that company, regardless of the bid. You might also ask for references and check them - if you don't get any or they seem to have canned responses, you can still toss that bid if you don't trust it.

This may be a good time for the Board to set up some rules regarding due diligence. It's true a business doesn't necessarily have to be registered, but you might want to require some basics, e.g. it must have a street address (not a PO Box or mail drop), appropriate licenses and certification, workman's comp, etc. All of that should be verifiable and if the board doesn't trust the property manager to do it, they can handle that part themselves (divide up the work, if necessary, so no one's overwhelmed).

The board can require verification of insurance, workman's comp, and licenses for any bid that is received. The CAM should be providing you with that information.
