In a community with (townhouses, condos & single family homes) that has a home owner board in addition to boards for the townhouses & condos, what authority if any does the homeowner board have to dictate ARC for condos or townhouses once all individual boards have been formed? Would that board have any ARC control over condo or townhouse property?

Yes, all boards are in place and have been for some time.

Is there/are there Architectural Control Committees? Whether there are or not, don't your governing documents tell you what changes you can make with or without Board or ARC approval?

A home owner board is comprised of residents from single family, condos & townhouses. It has been suggested that they have ARC control over a possible change on condo property. It would appear reasonable that this board would only have ARC control over the common area they maintain and not any ARC control over common area of the townhouses or the condos?

Maybe others are more familiar with your kind of set-up. but I live in a high rid condo and know for sure our ARC requirements are different than those for detached homes. So It would seem to make sense to have an ARC for each type" One for Condos; one for detached homes; one for THs?

Joyce ... Do you have a Master HOA Umbrella with many other HOA's underneath? Do the Sub-HOA's each have their own Board of Directors? If this is the case then each Sub-HOA section is responsible for their separate area's as noted in their governing documents. However, they also need to abide by the Master documents as well.

On the other hand you can also have one large HOA with Condos, Townhomes, and Single Family under just one HOA with one set of very large documents. In that case you would have one Board of Directors who would appoint the ACC and who would oversee all various areas of the development.
