Hi Everyone,
I am VERY new to HOA, first time ever being in one. We have a 3 member board, President, Secretary and Treasurer. Knowing that he was moving in 2 months time, the President ran for office and has now sold his house and moved. I have sent out emails to the Board as well as other HOA members and I CANNOT get a response. I have tried to decifer through these By-Laws and Declarations but it is like a Shakespearean Novel. There are 23 homes/lots in this HOA and it has long been a problem for most and therefore they want nothing to do with it, but I have now been here for 3 years and I want change and commoradory. Can someone please tell me how do I go about getting answers because no one seems to know anything and the 2 remaining board members will NOT respond to my emails.

You really need to see what the ByLaws and CC&R's have to say about it. It might well be that there is no impediment to a Director serving even if that Director does not own property in the HOA.

If he resigned, the other Directors on the board can probably appoint a new Director to serve out his term send them a certified letter requesting that they appoint you to serve out the remainder of the term.

Hi Susan ... Welcome to the Forum

Generally, the other Board Members will appoint someone to fill the Board Position for remaining term until your next Annual Membership Meeting. The Board between themselves will determine who wants to hold the various Officer Positions. In essence if someone new is willing to serve, but does not want to be President ... The BOD usually can vote to change Officer positions between themselves unless the governing documents dictate otherwise.
