HOA enforcing auto state inspection sticker checks

In PA cars are required to undergo annual state inspections. Our HOA sent us a letter that they will start enforcing auto state inspection sticker checks and you will be fined if your sticker is not up to date. This sounds to me like a clear overstep and abuse of authority. Arent law enforcement the only ones that have this authority? If the issue is cars that are unsightly for example, on bricks in the condo parking area then they can have rules against that but I think inspection stickers are going too far. I do not condone not having up to date state inspections, but what next, anyone with DUIs are not allowed anymore? Please advise.

HOA's can enforce your car license are not expired. I used to live in PA and familiar with the car inspection requirement as well. This is kind of in the "public" view. So it's kind of hard to say it's an invasion of privacy.

Now how they enforce such a rule would be the issue. I believe this issue would fall along of the lines of how they would treat an abandoned/on blocks vehicle. If they call the police for parking violation, then the police would notice the expirations.

A HOA is not above the law but live within it. They can make some more restrictive type rules like what color your house is to be painted. They just can't make laws that exceed local, state, or federal laws.

Sorry I do find they may within their grasp on this one...

HOAs should not be enforcing inspections or registration.
That is the responsibility of the local police.

However, HOAs can (and perhaps should) enforce their own parking regulations.

Our regulations specify that only vehicles with current registration and inspection stickers may be parked on the property.

If there is a violation of our policy, we inform the member that the vehicle may not be parked on the property until it is properly registered or inspected. If the member ignores our warning, we have the vehicle towed.
