our rules states under the heading Swimming Pools: an in ground pool can be installed in the rear of the lot as long as it complies with local laws." There is someone that has installed an above ground pool saying it does not state that you can't install above ground pools. I was wondering if others had dealt with something like this before. To me, that rule implies no above ground pools since it only mentions that you CAN have an in ground pool.

Mike, your rule says nothing about above ground pools and so your assumption is not valid. However, above ground pools would need approval by the ACC.

However, it does state that the pool "must comply with local laws". Depending on the size of the 'above ground' pool, your local municipality may speak to the need for a fence, and don't know about a permit.

I would agree with the majority here, unless it specifically states they are prohibited you can't assume. However, as Roger said they should have gotten ARC approval and equally as important be in compliance with all local ordinances.
