Hello!

I'm starting this topic in hopes to provide a place for folks living in the Devonshire community to communicate and collectively work together to express and address the on-going problems with issues in the community from WATER IRRIGATION to other issues not being addressed nor resolved.

I own two properties in this community and since I purchased the homes in March 2007 my clients "tenants" and I have had headache after headache trying to get irrigation water to the homes. I am sure there are other home owners within the community with the same problem and frustration since **** Homes and ***** Management acknowledge a high volume of angry people calling about their landscape dying while the public areas are getting priority water when water is available, to mitigate their own expense while not looking after the home owners. The incompetence and denial at ****** management and shift of responsibility at ****** is some of the worst I have seen. In the mean time I have about $20K of landscaping near death.

Jon - there are several problems with your post. First, since this is a national forum, it's not really appropriate to try to use it as a local discussion area. Second, HOATalks posting policies prohibit using specific company names. You may have a beef with the developer and the management company, but in this forum you shouldn't be posting identifying info for them.

As to your problems with irrigation, you may be stuck. The CC&Rs for your neighborhood specifically states:

"The area wherein the Property is located is desert. Irrigation water is not always reliable and water is not unlimited. Irrigation water may not be available due to drought, harsh weather conditions, governmental action, system breakdown, transmission failure, overuse by Building Lot Owners, or any other cause. No Building Lot shall have any right to continuous or unlimited water from any source, including, without limitation, from any pressurized irrigation system."

Looks to me like the developer has pretty much stated that you will never be able to count on having pressurized irrigation water available. You may have to fall back on using house water, or replacing some of your landscaping with xeriscaping.
