My neighbor who is the chairman of the design review committee built a treehouse in his backyard. He cleared many trees marring the natural landscape. The area looks like a campsite. I expresses my objection to this neighbor and to the president prior to completion of the construction but was told that the DRC approved the request. We are not allowed to have fences and my view is now children playing in a treehouse instead of the forest. I have recently submitted my appeal. There is no good ending. If they rule in my favor, the tree house will be torn down and I will be the bad guy. I am worried about my resale value in a couple of years. Thanks.

Paul, I think as long as you quote the exact sections of the covenants and/or Declaration supporting your position, I think you are on solid ground and doing the right thing.

Sometimes it's a few sections of the Declaration and covenants that may apply to scenarios like yours.

This factors in on your selling potential how? A HOA is NOT to keep property values but the ATTRACTIVENESS of the homes. You have no idea why buyer doesn't buy your home. I hated the wallpaper of a house and did not buy it. Did it make it less valued? No. It just made it less attractive.

This is more of a personal taste issue than a property value decrease issue. Unless you can prove you can not sell your home because of a tree house that the HOA approved. You don't have much of a case.

Kids will grow up. Kids will fall off the tree house, and one of you is going to move in a few years... Adjust...
