What are your thoughts about the following? I am not inclined to share this information, I don't know that it can't be stolen, would I be liable if someone

Another matter, this is a second request. The bylaws state that we need contact information for the renters. Of the 8 renters, I only have contact information for 3. Please send this information EVEN IF YOU BELIEVE I HAVE IT prior to the annual meetin to be scheduled in May. Phone and e-mail would be preferable. At that time penalties for failure to follow the bylaws will be enforced. This is critical in case of emergency as there are issues that involve the renters such as moving cars to allow snow removal.

8.11. Occupancy Registration The name, telephone numbers (home and emergency), email address and correct street address of the Owner of the Unit and the occupants other than the Owner; and any changes in this contact information as they occur will be provided by the unit Owner to the Board Secretary.

This tenant's info is common. We, for instance, are a high-rise building and could need the info for any number of matters including emergencies. And your own governing documents seem to say you must supply this info. When you bought into your HOA, you signed saying they were OK.

Do you live on the premises too? How could you not have phone numbers for some of your tenants?

For what possible reason would someone on the Board or the property manager want to steal your tenants' identity?

I had a hard time following your writing so maybe I missed something.

I think the middle paragraph is quoting a letter Doug recieved for the HOA. The final paragraph must be from the CC&Rs.

@Doug: give them the name and phone number of the individual(s), that's reasonable. The HOA already knows the address of any renters, then the HOA can ask the renters for their e-mail.

In the future, add into any rental contact that the name and phone number of the renter will be provided to the HOA as required by the governing documents. This way, the renter is now aware.

Better yet, protect yourself and your tenants by making sure your rental agreement has the caveat that they follow the HOA rules. The HOA can NOT enforce the rules violations onto your tenants. The HOA has to enforce their violations onto you the owner/member. So if your tenant is leaving the garbage out and your HOA rules say it has to be brought in at a certain time/day, then you the owner will be responsible. Which means if they fine for such violations they will go to you. You can't evict your tenant unless you have that caveat in your lease agreement. Just food for thought...

As for the HOA wanting to know who the renters are, I see no problem with that. They know the address. The HOA isn't doing a background check or approval of the tenants. They just want to know they exist and who they are in order to contact. The HOA does need to know it's rental rate. It is reported and monitored by a HUD form in some home sales.

What is your concern about your HOA wanting this information? It's either you give it to them or your tenant. I used to rent out my HOA home. Did not have a problem if the HOA knew it or knew who was in it.

Sound very reasonable to me, we do mostly short term rentals and I require the very same information or they can go someplace else.
