I hope all had a wonderful Christmas, holidays or Hanukkah!

Our HOA has no employees, have only two floors, no elevators or pool with only 28 units. We use a cleaning service once a week, and landscape people.

Are we required to have workers comp insurance in Florida for the above mentioned services.

We do carry a good liability insurance, should that be enough? This is a small complex of about 28 units, and always trying to keep our expenses low but at the same time be protected, so I really appreciate any guidance or suggestion on the issue, and again thank you all for always been there to share your experience, time and knowledge to help others and I say this sincerely grateful!

The big thing to do is make sure that the contractors you hire have workers comp.
If they do not, insist that they obtain it or find a new contractor.

I would also go to the Better Business Bureau website to check the contractor out. Many contractors will put that symbol on their cards or advertising, just to find out it's not accurate.

One purpose of Workman's Compensation Insurance is to protect the employer against personal injury claims from his employees. In many states, including my own, receiving WC payments prohibits bringing a lawsuit against any other party.

My own experience with WC as an employer was that I was required to identify each employee by name and SSN, provide the employee's job code, and report his wages. The job code and wages would determine how much I had to pay for the insurance.

My first guess would be that you would be unable to obtain valid WC for the contract workers. They are not your employees, you do not know their names, SSN's, job codes, or wages.

That is good point, now we have the Management Company saying that we must have it.? But we don't have employees?
