I was wondering if anyone knew what it means in the documents for a sub association of homes (gated) if the bylaws state the following.
It is acknowledged tht the Association is not intended to be a condominium association and is not intended to and shall not be governed by the provisions of Florida statutes, chapt 718

Seems clear...chapter 718 is the Florida Condominium Act. I assume you don't consider yourselves condominiums?

I know of some recent developments in Central Florida that consider themselves townhomes governed by FS 720 rather 718. My guess is that your Association is saying the same thing.

No we are a gated community within a development of three other communities. The reason we are asking is due to recent problems with the Master Association who is only working on an Agenda. We are looking for that line in the sand that makes it clear who governs us.... We turned over two years prior and have been running smoothly and are consistant on our street, we also have stricter guidelines and compliance than the Master, the three communities outside of our gates are poorly maintained yet the Master wants to come in and impose rules/regulations and Architectural guidelines on our residents. There are NO common properties within our gates. Our residents are having huge issue with the fact that we pay two association fees, one to our hoa monthly and one annually to the master and that they just turned over in January and the lack of enforcement outside of our community.
