For those of you that may remember my post from months ago this is an update.

Our shared parking lot has been resurfaced. We have a signed agreement with our neighbor a Care Center allowing us to use the first row of the lot. Our PM has used green paint to stripe the lots we us. Since we have 13 units that do not have a garage parking space, our PM has pained (going from South to North) the number of each unit that does not have a parking spot in our garage.

The employees of the Care Center have been told not to park in the green spaces or they would be written up. Also we have signage indicating cars will be towed if it is parked in one of our spots and not a resident /owner of a condominium.

Later we may get signs to place above ground as in NE snow May cover our lines and numbers.

Good that you've made progress on your parking issues, Bonnie. I know its' been a problem for a long time.

I think, abiding by your other governing documents or NE statutes concerning making rules, you need to make rules for these numbered parking spaces. Otherwise, you can be sure someone who's not supposed to will park in them. Make a fining schedule to go along with the rules.

Your HOA might not always be willing to tow. In fact, who in your HOA would call the towing company? I don't believe your PM is full-time.

The Care Center employees have been told not to use our parking spaces. They are clearly marked a different color than the spaces the employees of the Care Center are allowed to us. The number of the unit that is allowed to use the space is painted on it in bright green letters.

The problem we are having is with visitors to the Care Center using our spots in spite of the signage that indicates the care will be towed. I don't want to have a visitors car towed. I, as President would be the person to call the towing company but then I am not on site all the time either.

The problem we are having now is with a couple who have three cars and were told before they bought the unit that only as many vehicles per licensed drivers in the unit will be allowed to be parked anywhere on the property. I am working on a resolution as to how occupants of the condominium are to use or let others use the outside parking spot that is connected to their unit.

I repeat, bonnie, your HOA needs written rules. No owner should be "told" anything. rules need to be in writing.

I guess I did not explain myself well enough. We do have the rule in writing. It is in the form of a resolution that no more vehicles can be parked on the property than licensed drivers living in a unit.
As I do with any prospective owner, I verbally tell some rules.

The NE state laws, our Master Deed, By Laws, and resolutions are all in our library available to any of our members. Also before anyone purchases a unit our PM usually e-mails the realtor a copy of our Master Deed and By-Laws. I give them a copy of our covenants that shortens some of the rules for them. We do have written rules If something is not written, we do not enforce it.

What I am working on is a resolution as to how we will use the outside parking lot so that we will not take parking spots away from employees of the Care Center. Until recently it was just first come first serve as to who parked where in the outside shared lot.

After your board agrees on them and votes on them, you'd send them to Owners so that they know what is expected of themselves or their tenants. These would be added to your existing rules.

Here is an example: what if (hypothetical) space #50's assigned unit doesn't have a car. Can that unit's resident rent that space out to another resident?

Can residents with assigned spaces have their guests park in "their" spaces?

As you can see I have already begun to work on the written rule regarding the use of the outside parking spaces. Yes, any resident will be able to let any other owner/resident use wither free or for a price the space assigned to the unit.

I have already had the lawyer who lives on site review the resolution but may still send it to the Association's lawyer for review. Since I am to be at the hospital today at 1:00 P.M. Central Daylight Time for major surgery, I will not be able to do any more regarding the problem of outside parking spaces until I have recovered enough from surgery to work on it. I will be in the hospital at least two days and maybe longer. I am so glad there are other very capable Board Members that I have complete confidence to handle any and all matters that might arise as I recover from surgery.

Once again the rule that a unit may have no more vehicles than licensed drivers living in the unit parked anywhere on the property is already a written rule. This rule was made long before we had designated outside parking spots for the 13 units that do not have a garage parking spot. It was a written rule before the man who is giving us the problem moved into his unit. Parking here is at a premium due to sharing the parking lot with our neighbor, the Care Center.
