We are in Colorado and are having problems with our HOA. Our area was built out of code and the driveways are too short, resulting in people parking on sidewalks and not allowing for those in wheelchairs any amount of access and putting them in danger. The HOA has refused to follow their own guidelines (we have been fighting for nearly 3 years, they have a written policy that states for safety issues it is an immediate action, going to court to remedy the situation). The Association and their attorney have begun to give out our name, address and other protected information which has escalated to us having to call police due to people photographing and harassing us for trying to get the association to enforce parking rules and making sure sidewalks are not blocked. The attorney and board have said they will continue to provide our information, there is no protection for us. Their own policies say that any complainant information is to remain anonymous, the CCIOA also states that the board has to protect as well. The association and attorney have said, in writing, that they will continue to provide our information irregardless of current rules or state rules. I have pointed out, in writing, that this violates CCIOA as well as the associations own policies to which they never have relpied.

What are my options? Can the police help? I have filed with DORA as to the CCIOA violations but am at a serious loss as where to go from here.

I read more into this situation... Your name and address isn't that private. Plus people can take pictures all they want outside your home. It's public viewing. So not sure what violations are really happening as everyone defines "harrassment" differently. Taking pictures and having your name/address doesn't seem like anything the court would consider harrassment. If there was, then the police NOT the HOA is responsible.

Just a suggestion - take a look at your state's "anti-stalking" laws. Often such laws prohibit harassment as well. Since these are criminal laws, the board members behind the harassment can't avoid the possibility of being prosecuted individually for violating those laws. Note: you can't threaten them with possible prosecution if they don't stop. Then, you would be committing the crime of extortion. You need to just go ahead and file criminal complaints against them if you think the law applies to what they are doing.
